The international association L'ESCOLA AC yesterday filed a complaint with the Prosecutor's Office against several surrogacy agencies, for a possible commission of the crimes established in articles 221, 222, 570 bis of the Penal Code. These articles refer to crimes against family affiliation and membership in a criminal organization.

In the same complaint, L'ESCOLA AC points to the consuls who validated the registrations in the foreign consulates of Spain after the Supreme Court ruling of February 2014, that considered surrogacy contracts null and void and, therefore, inapplicable in Spanish law, as possible authors of an alleged crime of prevarication included in art. 404 of the Penal Code.

Through this complaint, L'ESCOLA AC intends that The Prosecutor's Office investigates the allegedly international criminal network that exists behind the surrogacy agencies that operate commercially in Spain with total impunity, despite being a practice prohibited by Spanish legislation.

In the same complaint, the Prosecutor's Office is urged to initiate the necessary procedures to achieve the annulment of the Instruction of October 5, 2010 of the General Directorate of Registries and Notaries, which allows the registration of babies born through surrogacy in Spanish consulates abroad, through possible fraud of law.

At L'ESCOLA AC we trust that the appointment of the new Attorney General, Dolores Delgado -whose position against the reproductive exploitation of women is clear and public-, be reflected in lThe real and definitive ban on surrogacy in Spain, since it is a practice prohibited by law but which is being imposed through the Act of who can pay for it, which violates the most fundamental rights of women and children, since the Attorney General's Office is the only body with the sufficient material and human resources to undertake an international investigation of this magnitude.

Besides, This prohibition would be consistent with the electoral program presented in the campaign by the majority party that is currently in the Government.. Therefore, it is only in your hands, through the cancellation of an administrative instruction – which does not require any parliamentary procedure- demonstrate that the new Government is in favor of the rights and dignity of women and children in daily life and not only when there is a campaign electoral. At L'ESCOLA AC we trust that this will be the case.
